Elite Members

Through this program, an H-2B worker, who has at least two (2) years of experience in his/her position may be able to obtain Permanent Resident Status, enabling him/her to work for your company on a permanent, full-time basis.

 

However, it is important to note that while many non-immigrant workers have successfully applied for permanent residency, the application process is time consuming and could possibly result in denial.  Currently, the process takes anywhere from two (2) to five (5) years to complete and, like the H2A and H-2B Visa process, involves the following governmental agencies: State Workforce Agency (SWA), United States Department of Labor (DOL), and the United States Citizenship and Immigration Service (USCIS). 

 

In the Elite Program:

 

  • FEWA staff attorneys will help your company apply for Labor Certification with the DOL and assist you and the worker with completing all forms required to apply for Permanent Resident Status with the USCIS.   
  • The workers will be applying for permanent residency based on a full-time, permanent job offer with your company.

 

 Other important things to know before enrolling in the Program:

 

  • Permanent residency is not guaranteed.  The company or worker’s applications could be denied by the DOL or the USCIS.
  • The company must be able to demonstrate to the DOL and USCIS that it has a need for full-time, permanent worker(s) and is financially able to support those workers.
  • The worker has NOT applied for Permanent Resident Status until his/her application for adjustment of status has been submitted to the USCIS.
  • A history of illegal presence or criminal conviction(s) may disqualify the worker.
  • Once a worker files his/her application(s) with the USCIS, he/she may never again be able to receive an H-2B visa.
  • The company must be offering a full-time, permanent position, which is DISTINGUISHABLE from the worker’s current position (if worker’s experience was gained with your company).
  • The company and the worker must be members of FEWA.
